{"id":84082,"date":"2019-02-28T17:33:53","date_gmt":"2019-02-28T21:33:53","guid":{"rendered":"http:\/\/www.fne.gob.cl\/tdlc-acoge-requerimiento-de-la-fne-sancionando-a-cencosud-smu-y-walmart-por-colusion-en-el-mercado-de-la-carne-de-pollo-fresca\/"},"modified":"2019-03-04T16:54:59","modified_gmt":"2019-03-04T20:54:59","slug":"tdlc-acoge-requerimiento-de-la-fne-sancionando-a-cencosud-smu-y-walmart-por-colusion-en-el-mercado-de-la-carne-de-pollo-fresca","status":"publish","type":"post","link":"https:\/\/www.fne.gob.cl\/en\/tdlc-acoge-requerimiento-de-la-fne-sancionando-a-cencosud-smu-y-walmart-por-colusion-en-el-mercado-de-la-carne-de-pollo-fresca\/","title":{"rendered":"The Chilean Competition Tribunal upholds the FNE\u2019s collusion claim against Cencosud, SMU and Walmart"},"content":{"rendered":"\n<p>The Chilean Competition\nTribunal (TDLC) rendered a unanimous decision against the supermarket chains\nCencosud, SMU and Walmart for having executed an anticompetitive agreement or\nconcerted practice in the fresh chicken meat market, imposing fines totaling\nover $8.000 million Chilean pesos (approximately, USD $12 million).<\/p>\n\n\n\n<p>The TDLC upheld the FNE\u2019s\nclaim that these companies, through their suppliers, engaged in price-fixing by\nagreeing on the minimum sales price of this product at least between 2008 and\n2011, restricting competition in this sector. The minimum sales price was fixed\nat the wholesale list price plus VAT. <\/p>\n\n\n\n<p>The fine imposed by the TDLC\nagainst the supermarket chains are as follows: USD $5.1 million for Cencosud, <a>USD $4.2 million <\/a>for Walmart and USD $3 million for SMU.\nIn addition, the TDLC ordered that these supermarket chains adopt a\ncomprehensive and effective antitrust compliance program.<\/p>\n\n\n\n<p>The FNE stated in its claim that the\nsupermarket chains \u201c<em>consciously adhered\nto a common scheme that substituted the risks of competition for a practical\ncooperation between them<\/em>\u201d, in order to \u201c<em>regulate\nthe market<\/em>\u201d and \u201c<em>prevent a price war<\/em>\u201d.\n<\/p>\n\n\n\n<p>This mechanism was unveiled during the\ninvestigation known as \u201ccaso pollos\u201d (\u201cchicken case\u201d), in which fresh chicken\nproducers Agrosuper, Arizt\u00eda and Don Pollo were ordered by the Supreme Court,\nin October 2015, to pay fines totaling over USD$ 55 million. <\/p>\n\n\n\n<p>The aforementioned investigation led the FNE\nto conduct search and seizure operations in the premises of the main actors in\nthe supermarket industry. These operations provided the FNE with several\ndocuments that evidenced communications between executives of different\nsupermarket chains and fresh chicken producers, whereby the former executives presented\ncomplaints before the latter executives whenever they detected that another\nsupermarket was not respecting the agreed minimum sales price.<\/p>\n\n\n\n<p>The supermarket chains constantly monitored\nthe prices at which their competitors where selling fresh chicken to the\npublic, through their internal staff and through external companies\nspecifically hired for this purpose.<\/p>\n\n\n\n<p>The parties are entitled to challenge this\ndecision before the Supreme Court within 10 working days from the date of the\njudgment.<\/p>\n\n\n\n<p>The FNE reiterates that collusion is considered the\nmost serious breach of competition law and a fundamental part of the\ninstitution\u2019s mission is to eradicate collusive practices.
