Pre-Notification Consultations

In order to clarify certain doubts that may arise in the notification process of a merger, the Fiscalía Nacional Económica has a team of professionals especially selected for these purposes, where economic agents and their representatives can formulate consultations to the FNE, prior to notification of the relevant merger.

It is important to highlight this is a voluntary stage, arranged for the benefit of the economic agents that require it and its purpose is to guide the legal advisors of the parties in the notification process and comply with a complete notification in an efficient manner.

The economic agents and their representatives can initiate these communications prior to the notification at any moment beginning after the prospective merging parties agree that there is a real and serious intention to carry out the operation.

In this phase, the notification mechanism to use (ordinary or simplified), the request to exempt certain background information in the terms of articles 3 and 8 of the Rules of Procedure on Mergers Notifications and other specific doubts related to the notification process, may be discussed.
