Since 2016, the FNE has the power to make regulatory recommendations as stipulated in letter q) of article 39 of DL 211. According to what is stated in the aforementioned the law, the recommendations may come from an investigation or study on the competitive evolution of a market and are addressed to the President of the Republic, through the corresponding Minister of State.
Through these recommendations, the FNE may propose the modification or repeal of the legal or regulatory precepts that it considers contrary to competition as well as the enactment of legal or regulatory precepts when they are necessary to encourage competition or regulate the exercise of certain activities economic activities that are provided in non-competitive conditions.
