Leniency Guideline

The FNE published in March 2017 the “Internal Guidelines on Leniency in Cartel Cases”, which replaced the “Internal Guidelines on Benefits of Exemption and Reduction of Fines in collusion cases” of October 2009.

This objective of this document is to provide legal certainty to whoever wishes to obtain leniency benefits, and to limit the scope of discretion conferred by the law to this agency.

The Guideline was submitted to three public consultation processes, in which it received comments, suggestions and contributions from various organizations such as the Chilean Bar Association, the American Bar Association, the International Bar Association and the US Department of Justice. Furthermore, it incorporates the changes recently made to Decree Law No. 211 through Law No. 20.945.
