What we do

Leniency systems have proven to be in Chile, and the rest of the world, the most effective mechanism to detect, sanction and deter cartels. In Chile, this figure exists since the legal reform carried out in 2009 and it is regulated in articles 39 bis and 63 of the DL 211.

The leniency program allows exempting or reducing the sanctions established by law for those who, having participated in a cartel, provide evidence that leads to proving the illicit conduct and determining those who perpetrate it.

For this purpose, the FNE has a professional in charge of the leniency program and organizes ad-hoc teams each time it receives a request for these benefits.
