09 / 12 / 2020

The National Economic Prosecutor’s Office (FNE) will hold its Competition Day, through the Zoom platform, on Thursday, December 17 at 10:00 a.m.

The event is titled “Compensated Whistleblower and Criminalization: A look from North American Law” and will feature the participation of US experts Richard A. Powers, who is Deputy Assistant Attorney General for Criminal Prosecution of the Competition Division of the Department of Justice of the USA, and Scott Hammond, Partner at Gibson, Dunn & Crutcher, LLP.

The objective of the meeting is to review the main challenges imposed by the latest reform to the Chilean free competition law in terms of sanctions and compensated denunciation, in light of the experience of the United States of America, the pioneer and most successful jurisdiction. shown both in the use of compensated denunciation to detect and accredit cartels, as well as in their criminal prosecution.

“The new legal scenario forces us all to rethink the compensated denunciation, the incentives to take advantage of the benefit, the associated risks, the role of the whistleblower and his lawyers and also the role of the authority,” said the National Economic Prosecutor, Ricardo Riesco.

The meeting will begin with the words of Prosecutor Riesco and will be moderated by the Economic Coordinator of the Anti-Cartel Unit of the FNE, Isabel Asenjo.

This is the 17th version of the traditional annual seminar, which last year had to be canceled due to the national contingency.
