What we do

The Merger Division is in charge of the preventive control of mergers and acquisitions in our country. A notification to the FNE of the merger is mandatory when the revenues of sales in Chile of the economic agents that merge exceed certain thresholds which are established by the agency.

Our objective in evaluating mergers is to determine whether or not they can substantially reduce competition in the affected markets, for which we have a multidisciplinary team formed by lawyers and economists.

The control procedure is divided into two phases. The first one, has a duration of 30 days from the beginning of the investigation and can be extended to a second phase for an additional 90 days, in case it is resolved that the operation can substantially reduce competition in the relevant market that is being studied.

The Division is responsible for:

  • The analysis of mergers in accordance with the provisions of Title IV of DL 211.
  • The oversight of measures adopted in resolutions that approve a merger.
  • Inspection to check eventual violations to article 3 bis of DL 211.
